Can Donald Trump seek a third term – and what are his options? | Donald Trump News

Donald Trump said on Sunday that he “is not joking” about the possibility of searching for a third term as President of the United States, although the US constitution prevents presidents from electing more than twice.

“There are ways you can do,” Trump said when asked if he was serious, in an interview with NBC News. He alluded to one of these methods, he referred to the Vice President JD Vance, who runs in 2028 and stepped down if elected, to allow Trump to take over.

“But there are others too,” he added, without a situation. “Many people want me to do it.”

The note sparked a wave of warning and speculation, especially since this was not the first time that the idea was floated.

So, can he really do this? What are his options?

Did Trump disturbed a third state before?

Trump has repeatedly alluded to stay in power until two periods.

In 2018, in the collection of donations at Mar-A-Laggo-his home in his resort in Florida-Trump referred to the term Chinese President Xi Jinping in office and jokingly: “Maybe we will give that shot one day.”

During the campaign gatherings, he said that his supporters may demand that he serve a third term, once in reference to it as “compensation” for investigation due to Russian intervention. In 2020, he said in a post on social media that “the elections must be delayed so that people can vote safely and safely,” which raises fears again that he may try to overcome his term.

Steve Bannon, the former chief strategy, also made public statements indicating that Trump and his aides have explored unconventional ways to adhere to power.

In a recent interview, Bannon expected that Trump would win and win again in 2028.

“I think he will run again in 2028 and I think he will win,” Bannon said. “I think we will have two alternatives,” said Trump for a third term despite the constitutional limits.

Whether this is a strategy or just a policy as usual, it highlights a repeated topic in Trump’s narration, which tests the borders of the United States constitution.

What does the amendment 22 say?

The twenty -second amendment stipulates the constitution of the United States, which was believed in 1951, that “no one may be elected to the President’s office twice.”

The language appears clear, crowned the number of presidential elections that a person can win in two years.

But some of Trump’s allies argue that he leaves room for interpretation – specifically, that although a person cannot be elected more than twice, it may be possible to become president through the caliphate instead of elections.

Why was the amendment 22?

Before Franklin de Roosevelt, no president served more than two periods – a tradition that George Washington started and respects more than 150 years.

But Roosevelt was elected four times, as he served from 1933 until his death in 1945. In response, legislators moved to pass the twenty -second amendment, which the states believed in 1951. The goal was to write down the term traditions and prevent any future president from the position for more than two periods.

How can Trump try to circumvent the amendment 22?

Trump’s most common vulnerability includes the operation of the Vice President in 2028. If a president is elected, then he will resign, die or remove from office, Trump can theoretically succeed in the presidency.

This concept depends on a tight reading of the twenty -second modification, which prevents a person from electing more than twice – and not from serving more than two periods. Supporters of this theory argue that the amendment may not prohibit Trump to become president through the caliphate line.

Some legal scholars reject this as an applicable option, including the constitutional law expert Bruce Vin.

Vin told Al -Jazeera: “There are zero constitutional methods to circumvent the twenty -second amendment.”

Fein warned that if Trump is seeking to face the twenty -second amendment, there may be a few other borders that the president holds, in his attempt to adhere to power.

Vin said: “Trump hopes to ignite the constitution and crown himself as a king in a Napoleon … the self as an emperor in 1804.” “If Trump escapes from the twenty -second amendment, he will not have anything to challenge court orders … the army calls for the arrest of judges, prison, legislators and political opponents.”

One of the restrictions specified on Trump using the drafting of the amendment 22 kg? The twelfth amendment, some scholars say.

What is the twelfth amendment?

The twelfth amendment states that “no person is unconstitutional for the president’s office qualified for the Vice President of the United States.”

In clear phrases, if Trump is no longer qualified to be president, he has already served two periods, so the Vice President cannot also be, according to the dominant interpretation of this amendment.

“Trump will also be prevented from running for VP in accordance with the twelfth amendment because it will be not qualified for the presidency,” Fin said.

Therefore, the courts may explain Trump’s nomination as a vice president as a direct violation of the constitutional intention.

Is it possible to cancel the amendment 22?

In theory, yes. But it is very unlikely.

The cancellation of the amendment will require 22 constitutional amendments: supporting two -thirds of the House of Representatives and the Senate, followed by ratification of three quarters of the state legislative bodies (38 out of 50 states).

Currently, Republicans control about 28 legislative fragments – much less than the required number. In Congress, Trump does not support the necessary two -thirds in any of the room.

Are there other ways that Trump becomes president again?

Technically, yes, some lawyers argue.

If Trump is elected Vice President, the elected president may not even need to resign from Trump to effectively lead the nation, the law firm in Pennsylvania has suggested effectively in an article a few months ago. In theory, if the president is temporary impotent, Trump may be a “prosecutor” under the twenty -fifth amendment.

The argument again depends on the fact that the 22 modification tapes are elected more than twice – do not necessarily put the office again through other means.

However, the Cornerstone article also admits that this interpretation has not been legally tested and is likely to face great challenges.

For example, like Trump, like Trump enters the presidential line of the caliphate through a date in the cabinet, for example, it was put forward, but it again requires the movement of dangerous constitutional and political roads.

He can also serve as an informal “president” in a future administration, which carries a huge political impact without the official title.

But until then, the courts are likely to consider the total purpose of the twenty -second amendment – which limits the time when someone can remain in power in any way after two periods.

However, where is Trump’s speech and intentions should not be rejected as just hunting.

“Except for two times, Trump puts the stage to light the match with the constitutional system,” he said.

He said that in the end, the law is only strong like the public’s willingness to support it. This is what people want to “fight and die for.”
